Full Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions and by participating, all participants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

Promoter: Oddbox Delivery Ltd, Unit 3.09, Food Exchange, New Covent Garden Market, SW8 5EL.

1.   These free prize draws on social media (“Promotion”) are for 1 entrant to win a copy of Crunch Time. They are open to UK and Northern Ireland residents aged 18 or over excluding employees and the immediate families of the Promoter, its subsidiaries, other group companies, its agents, professional Instagram or Facebook users, social media influencers or those who work in the electronic consumer goods marketing or social influencer industry, or anyone else professionally connected with this promotion.

2. In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter will require you to provide identification proof that you are eligible to enter the Promotion by being aged 18+ and a resident in the United Kingdom.

3. The promotion will run from 17:00 01/05/24, closes 23:59 30/06/24 (the Promotional Period)

4. Internet access is required and entrants will require an active email address in order to do this and redeem your prize.

5. To take part in this Promotion you must do the following (Entry Criteria):

a. Sign up to the Oddbox newsletter

b. Be located within the Oddbox delivery zones

6. Winner Selection: There will be 1 winner chosen at random from all entries that meet the Entry Criteria above.

7. Only one entry per email address – total one winner.

8. The Promoter monitors responses to this Promotion and if any responses made by an entrant are, or could be regarded, as being disrespectful or could cause offence or distress will be removed from the Promotion. The Promoter will not accept any liability in this regard.

9. Participants’ entries will be deemed invalid if any entrant:

-    is outside of the Oddbox delivery zones

-    has an email address that contains defamatory, malicious or other inappropriate content

-    includes any individual without their express permission

-    is any person that is under 18

10.   Participants who do not give correct details or those who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.

11. Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

12. Other than as stated, any expenses incurred by the winner in the general use and/or enjoyment of the prize, are the sole responsibility of the winner.

13. No cash or other alternative prize will be provided in whole or in part, except that in the event of circumstances outside of its control the Promoter reserves the right to substitute a similar prize of equal or greater value.

 14.   The winner will be contacted via the email address: hello@oddbox.co.uk by a response to their initial newsletter signup within 5 days of the promotion close date and will have 7 days immediately following to contact the Promoter as directed in the message to confirm details (name, email address, postal address and age) in order to claim prize. Note that the winner must live and provide an address in the United Kingdom, within the Oddbox delivery zones. If the winner does not respond within the 7-day period another winner will be selected using the same methodology as above. Participants are encouraged to monitor their connections during this time in case they are a winner.

15.   The prize will be posted to the address supplied by the winner within 14 days of winner confirmation. Note that Oddbox are only able to deliver boxes within Oddbox delivery zones, please ensure you check if you are eligible for delivery here: https://www.oddbox.co.uk/delivery 

16. The winner may be asked their consent to take part in reasonable publicity in connection with this promotion. The promoter is entitled (but not obliged) to use the winner’s name and image in connection with such publicity. 

17.   The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which they must provide within 7 days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotions entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

18.  If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries/claims. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

19.  The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud).

20.  If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

21.  These terms and conditions (and any non-contractual issues which arise out of or in connection with them) will be governed by relevant local law with any disputes as to the meaning of these Terms and Conditions shall be subject to the exclusive jurisdiction of the English and Welsh courts.

22.   The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. Your personal details will at all times be kept confidential and in accordance with current Data Protection legislation. You can request access to your personal data, or have any inaccuracies rectified, by direct contacting Oddbox directly.

23. By participating in the Promotion, you agree to the use of your personal data as described herein.

 LIMITATION OF LIABILITY

Insofar as is permitted by law, ODDBOX and distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of ODDBOX, its agents and/or distributors or that of their employees. Your statutory rights are not affected.

DATA PROTECTION AND PUBLICITY

• By entering the competition, you agree that any personal data supplied to the promoter in connection with the competition (including your name, address and contact details) may be used by ODDBOX, its partners and/or any third party suppliers (as applicable) in connection with the administration of the competition and for any other reasonable and related promotional purposes. • ODDBOX will only use the personal details supplied for the administration of the promotion and for any other reasonable and related promotional purposes, unless we have your consent. Your personal address and email will at all times be kept confidential and in accordance with applicable data protection legislation.
• Under Article 17 of the GDPR individuals have the right to have personal data erased/to be forgotten. Any individual who is no longer happy for their personal information, entry or content or would like any inaccuracies rectified, can request this by sending an email to hello@oddbox.co.uk. By participating in the Competition, you agree to the use of your personal data as described here.

GENERAL

• If there is any reason to believe that there has been a breach of these terms and conditions the promoter may, at its sole discretion, exclude you from participating in the competition, to withdraw the prize.
• The promoter reserve the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so.
• If a provision of these terms and conditions is or becomes invalid or unenforceable, that part shall not affect the validity of the other provisions in these terms and conditions, and shall be severed from those provisions.
• These terms and conditions shall be governed by English law, and you submit to the exclusive jurisdiction of the courts of England and Wales.
